Just pondering here ....

Would WB be authorized to release alternate mixes that were delivered to
them by Frank Zappa when he was under contract with WB ?
(I'm guessing that WB may have only returned to FZ the original masters,
not all 2nd generation masters. I could be wrong.)

I'm thinking 'no', but I'm also thinking that there could be a loophole
in the agreement between Ryko and ZFT if it weren't written carefully
enough and just said something along the lines of 'as delivered to Ryko'
without identifying exactly to which recordings in their possession that
pertains.

Well now THAT's an interesting question.

My guess is that the situation that you present is unlikely. First,
it's predicated on the idea that WB still has FZ masters in the vaults
somewhere. As you indicated, this may not be the case.

Let's say that it is that case, however. And, let's say somebody from
WB rummages through some old master tapes and stumbles across a 2nd
generation master of...oh....I don't know....let's say, HOT RATS! And,
let's say that Ryko finds this out and has it sent to them in some sort
of an intercompany transfer. And let's say, several months later, Ryko
decides to release Frank Zappa-Hot Rats: Deluxe Edition. Disc one-1993
FZ approve master. Disc Two-vinyl mix derived from 2nd generation
master.

We all know what happens next. Gail's lawyer springs into action. A
cease and desist order appears immediately and all offending CDs are
recalled.

Then, Frank's worst nightmare comes true. Gail has to sue WB.

Now, I think that it is somehow written in Ryko's contract that they
cannot release anything that isn't either an FZ Approved Master or
delivered directly from ZFT for the purpose of release by Ryko.

On the other hand, I could see a situation where Frank Zappa recordings
cannot be released on the WB, Reprise, Bizarre, Straight, or Discreet
labels, but CAN be released on the Ryko label, as long as it is
material that has been identified in Ryko's contract regardless of what
the source of the material is (if that makes sense).

Now, for the WB material from 1972-1975, this is irrelevant, as the
current CDs are good or better representations of the original albums,
however, where this is not true, the following material could be
addressed:

Uncle Meat
Hot Rats
Burnt Weeny Sandwich
Weasels Ripped My Flesh
Chunga's Revenge
Fillmore East, June 1971
Zoot Allures
Zappa In New York
Sleep Dirt
"My Guitar"-single version
"Dog Breath"-single version
"Tears Begin To Fall"-single version
"Junier Mintz Boogie"

But, even if Ryko can do this legally, Gail is not going to just sit
back and let it happen. There would be legal ramifications.

Interesting thought, though.

I suspect that the Lather incident made FZ, Gail and company fairly
eager to make certain that WB wasn't still holding on to any Zappa
tapes.

Hmmm, that's an interesting thought.
I was also thinking since WB also owns Rhino, Gail only has to take
legal actions against one company (at least for US) now.

That's what I thought.

The "Uh-Oh" post has/was been there a while. I took it to mean that
whatever time period that Ryko had the titles licensed for had passed
and that, being thoroughly disgusted by the way they handled certain
aspects of the deal, Gail was reviving Zappa Records for the purpose of
re-issuing the original titles.

I'm not even going to speculate as to whether bonus material would be
included so as to provide an incentive to buy them yet again.

The deal with Ryko prevented the ZFT from releasing *new* albums for ten
years (presumably to avoid competing with the 1995 Ryko reissues). Now
that that time has passed, the ZFT can release new albums and distribute
them by means other than mail-order. (See p. 73 of the current issue of
Relix.)

The interview doesn't say anything about Ryko no longer having the
rights to put out the *old* albums.

Yeah, I need to read that. I didn't know that the deal prevented them
from releasing new albums. Considering the fact that the ZFT had
"scheduled" releases ready to go (e.g. Dance Me This, Transfusion),
Ryko must have offered a pretty penny for that kind of agreement.

I just went back to the "Uh-Oh" page and the verbiage is different than
what I remember. Oh, well.

In the Relix interview, Gail refers to "any recording involving a
touring band". So I don't think the agreement with Ryko was preventing
the ZFT from releasing Dance Me This.
